FACTS: On Feb. 27, 2003, a 38 year old seamstress, and her daughter, plaintiff's decedent, age 9, were struck by a van. The incident occurred at the intersection of Allendale and Liberty avenues, in the Jamaica section of Queens. The daughter was killed. Her mother claimed that she sustained jaw and knee injuries.

Plaintiff, acting individually and as administratrix of her daughter's estate, sued the van's driver, Antonio Oriol; the van's owner, Professional Charter Service Inc.; the company that operated the van, Consolidated Bus Transit Co.; and several other purported owners and/or operators of the van: the city of New York, the Manhattan and Bronx Surface Transit Operating Authority, the New York City Board of Education and the New York City Transit Authority. The plaintiffs alleged that Oriol was negligent in his operation of the van.
